Background:

How it started:

The idea for this event started at a picnic in a park in the middle of Atlanta on a warm spring day this year. Five of us, all volunteers with CRY America, were racking our brains for a special event that would connect with all Indian-Americans, regardless of which region they were originally from, where they lived or worked at present, what their income levels were or what language they spoke at home. One of us had a ‘Eureka’ moment and she exclaimed that the one thing that was common amongst all first generation immigrants was: communication with and travel back to India. Most make trips home at least once every 2-3 years, and it is almost always an expensive venture, plus a nostalgia-& emotion-filled event. Be they students or software professionals or self-employed small business owners, or even doctors or successful entrepreneurs, the $2000-odd required per head for the India trip is a substantial expense.
Our initial idea evolved, and we studied it as scientifically as possible, with a quantitative market research plan and a survey. YOU told us what you wanted, and we put together our best efforts to make it happen, and together, we hope that all this results in the beginnings of a better world for children.

Now, we’d like to introduce a first-of-its kind vacation sweepstakes targeted to the South-Asian community in America, and designed to raise funds to support child rights. 

What YOU told us:

• Travel tickets to India/anywhere in the world or travel vouchers rank in your top two options
• Most of you like to purchase raffle tickets primarily when they support a good cause. Over 30% of you have, in the past, bought raffle tickets that were for a good cause.
• You prefer tickets to ‘anywhere in the world’ for more flexibility (duh! )
• $25 and $50 are two ‘sticky price points’, i.e., more of you are more comfortable at these price points than at nearby rates. 7 out of 10 confirmed that they would ‘definitely buy’ or ‘strongly consider’ buying tickets to the above-detailed raffle.

What’s in it for you:

(a) You are investing in the building of a better world by restoring the rights of children to survival, protection, development and participation;

The maximum number of tickets that will be sold is 300, which ensures to every buyer a very high chance of winning.

CRY Annual Vacation Sweepstakes OFFICIAL RULES

The Sweepstakes opens August 10, 2007 and closes at the end of registration at October 12, 2007. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. Winners' names will be randomly drawn from all entries received. Sweepstakes is organized and supported by CRY America, Inc. (“the Sponsor”). CRY America is a 501c(3) registered organization and donations are tax-exempt. Employees of CRY America or CRY India are not allowed to purchase tickets.
(1) ELIGIBILITY: The Sweepstakes is open to legal residents of the U.S. and Canada only, and to non-citizens visiting the U.S. or Canada on an eligible work or student visa. Participants must be age 18 or older as of the date of entry to be eligible. Residents of jurisdictions prohibiting such promotions should consider this offer void, including residents of Quebec. All federal, state, provincial and local laws and regulations apply. In the event this Sweepstakes is compromised in any way, electronically or otherwise, that is beyond the control of Sponsor, Sponsor reserves the right to withdraw the transmission of this Sweepstakes. A maximum of two raffle tickets will be sold per student ID. CRY representatives retain the right to withhold sales of the raffle tickets to any or all persons.
(2) HOW TO ENTER: Participants may enter the Sweepstakes by paying the amount to a CRY America volunteer or representative and collecting a numbered counterfoil. The raffle ticket entry is invalid without a valid number entered by the CRY America representative. All entries become the property of Sponsor and will not be acknowledged or returned. Entries must be received atleast 10 minutes before the official start of the draw.
(3) PRIZES: In case the desired number of tickets is not sold, CRY reserves the right to cancel the raffle or limit the number of prizes or their value. No alternative prize, cash equivalent, or other substitution is permitted except by Sponsor in the event of prize unavailability. Prizes are transferable at the discretion of CRY America. All federal, state and/or local taxes are the responsibility of the winners. Participants are responsible for all internet access fees, service charges, and any other fees associated with the use of the prize. Please refer to the gift certificate for more details and a complete list of conditions for each prize.
The top prize of two tickets to India are sponsored by Jet Airways, and have a 1 year validity and 90 days validity after issue. They cannot be used for eastward travel in December or for westward travel in January. The weekend's stay is via Starwood's preferred guest program, and is worth 10,000 Starwood points, valid for approximately two nights' stay at various properties around the world. To avail this program, the winner needs to be a member of the Starwood Preferred Guest program or needs to open an account (for free). This prize is not endorsed by Starwood or associated companies. The one-night stay at W hotel in New York at Times Square is valid only at that location, available for use until August 2008. The weekend stay at any W hotel is not valid at Seoul, Honolulu, Mexico City, etc. Any and all restrictions are placed by the sponsors, W Times Square & W Hotels respectively.
(4) SELECTION OF WINNER: The winners will be determined by random drawing of all eligible entries received. Odds of winning a prize are based on the number of eligible entries received. The draw is expected to take place on October 12, 2007 in Atlanta, GA, USA. You are invited to attend the draw at your expense. CRY will publish the results of the draw in Khabar, and make all reasonable attempts to contact the prizewinners using the contact details provided by them. Prizes will need to be claimed within 60 days of the draw and will expire to CRY if not claimed within this time period. The counterfoil must be produced in order to claim the prize. Without the counterfoil, it is at the complete discretion of the CRY America employee/volunteer in-charge of the draw event to provide or reject the claim. Winners will need to provide a full shipping address and phone number for fulfillment of the prize. Sponsor is not responsible for late, lost, misdirected or unsuccessful efforts to notify the winners. All taxes on prizes, including income taxes, and any incidental expenses associated with collection of a prize, are the responsibility of the winners. Winners assume all liability for any damages caused, or claimed to be caused, by participation or by any prize, and release Sponsor from any such liability. Winners may be required to sign and return a Release of Liability, Declaration or Affidavit of Eligibility, and where lawful, a Publicity Consent Agreement, all within 15 days of receipt by winners as a condition of receiving the prize. If winner is a resident of Canada, they may be required to correctly answer a math question provided by Sponsor. Answer to the math question, if required, must be returned to Sponsor within fifteen (15) days of receipt by winner. If a selected winner cannot be contacted, is ineligible, fails to claim a prize or fails to timely return the completed and executed declaration and releases as required, prizes may be forfeited, and an alternative winner selected. Prizes will be sent no later than 6 weeks after acceptance.
(5) TERMS AND CONDITIONS: Conduct of Sweepstakes and selection of winners are at Sponsor's sole discretion, and Sponsor's decisions are final and binding. Sponsor and its agents, representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors are not responsible for, and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible or postage-due entries; (ii) any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Sweepstakes; (iv) any injuries, losses or damages of any kind, arising in connection with or as a result of the prize or acceptance, possession or use of the prize, or from participation in the Sweepstakes. By participating in the Sweepstakes, each participant agrees to release and hold Sponsor and the employees, officers, directors, shareholders, agents, representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind, in connection with the Sweepstakes or resulting from participant's Sweepstakes participation, acceptance, possession or use of any prize, including, without limitation, personal injury, death and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Entrants agree to abide by these Official Rules and by the decisions of CRY, which are final.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Massachusetts, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Massachusetts or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Massachusetts.
